    Can a police officer be charged with murder in this situation?

    Basically for my story, I was thinking that since the evidence that the cop had would be inadmissible in court, maybe the cop could just kill the suspect and make it look like self defense. That way he will not have to deal with the suspect being let go, on inadmissible evidence, because the suspect is now shot dead because of "resisting arrest" so to speak.

    However, I read that in the law, if a cop is arresting you illegally, such as in a case where the evidence is inadmissible, the suspect has the legal right to defend themselves.

    If this is true, than would a cop killing a suspect in a gunfight be murder, since it was the suspect, who is the one defending himself against a cop, who has arresting on inadmissible evidence?

    Who would the law consider to be the one defending himselves, if the cop survived?
