Because fictional zombies are not real, how can there be any governing rules of operation at all? Basically anything goes. If a reader accepts a universe in which a zombie apocalypse occurs, the same reader shouldn't quibble about how those zombies behave as long as they obey the laws of that fictional universe.

Zombies or werewolves, in horror (or fiction with horror-based subject matter), the more you try and apply reasoning and logic to a creature or plague or whatnot, the less effect it has. You can talk about the zombies all you want and the reader can know exactly what they are but the fear of not knowing would work better with the characters emotions and the illogical situation works with confusion and fear a lot better than say, a character who knows exactly what's wrong and is trying to save the world. Of course everything I said depends on the writer.

    -overdone (obviously!)

One thing that annoys me as well is how bloody stupid they are. In most it seems that the "human" part of their brain has given in to the animal. Ok. But even a human with only instincts is quite intelligent. They can walk fast, run, react to sounds, remember faces, people, etc...

Yet here they're stupid, they don't remember anything (they don't need to anyway, since more often than not they die in the same page/scene), don't move fast (yet have two legs...), and are completely idiotic.

The original concept was exactly that. These things that look human, who may even be recognisable as friends or relatives, are now nothing more than eating machines with no conscious thought at all. The other thing of course, is that because they are mindless eating machines, it is OK to kill as many of them as you like without feeling bad. Not even PETA will blame you.

The Walking Dead (a TV series about zombies) is actually interesting in that regard, at first they hesitate to kill them, since they are very much still human-esque. Unfortunately, now it's turned into "take a cricket bat and cave their heads in without any repercussion".

Wouldn't you get desensitized to it though if it was real, instincts kick in and you come to realize that its kill or be killed. In a way we may not have been bitten but can still lose our take on humanity.
