If you give someone exclusivity over some of your rights, that means, by definition, that for the duration of that agreement you can't grant those rights to anyone else, they're not yours to dispose of as and when you might otherwise see fit, and you are therefore not retaining all your rights at all times, surely?

Which is the cause of my confusion, because I honestly think It's heavier than Lease. as shown in HarperCollins vs Open meadia, who sued the publisher because of a 1971 contract. I think It depends on the contract, how heavy or light those terms are.
