To make sure my new book's title was not taken by someone where can i check? i checked google, amazon, barnes and noble, and it seems ok. and where else if any? and what happens even if there was a same title because my title is not very far from generic, although it ill be a 3 word title
As I understand it, titles can't be copyrighted, and if someone had used your title for a work popular enough that he/she had it trademarked, your search would have discovered it, so I'd say go ahead.
there are lots of books with the same title - so long as its not iconic or uber well known (you wouldn't want to publish a fantasy called lord of the rings, or a book about bondage called 50 shades of grey) there ought not to be a problem
They might not be copyrightable, but could book titles be trademarks? I'm sure if I published a book called "Harry Potter and the Philosopher's Stone" I would soon receive a cease and desist from J. K. Rowling's lawyers. There must be a line between reasonable and infringing usage of the same title.
In the UK I think it comes under passing off .... ie you can have the same name as another product/business whatever so long as there's no intent to deceive. eg in Alex Garlands "the Beach" theres a character known as Daffy Duck and another one as Bugs Bunny .. however they are people who wee nick named after the cartoon characters , not replicas of the cartoon characters themselves. So you'd be fine writing a book with a character called Harry Potter, but not writing one in which hes a boy wizard
