Author has trademarked common word; threatening other authors over its use

    To be honest the court was never going to preempt the trademark decision, including that in the law suit was stupid but hey do we expect anything else....

    If you're on facebook, look up Suzan Tisdale, author. I believe she has worked as a paralegal at some point, and she is doing regular vids regarding this case. I will link them here when I can.

    Yes, you do - and it's the same with the Tax office, where I'm listed as "Mrs Cute Cat 22" business name, "Author Name" but that's not open to Joe Public

    Let me tell yeah, I feel sorry for the defendants and the Judge that has to put up with Hopkin's insanity. But I am rather enjoying the shit show as reported on my Ms. Tisdale. :)

    I think she was/is very worried about where this would leave authors in general, if FH were to win any part of her case. I know from a legal point of view, this is just the beginning. I think the next part is not going to be heard until some time in September??

    Probably. The Federal Court proceeding can be slow. And even the cancellation proceeding before the TTAB could take a year to a year and half.

    I find it very strange that FH has gone after (legally) a very small portion of fellow authors. Right or wrong, if she's going to throw her weight behind her trademark she should do it to all the cocky titles, not just pick and choose the ones she thinks she'll win against. Suzan is right with that when she says FH is only going after authors who haven't got the backing financially, to fight against her. Unfortunately, that is not how the law works.

    So considering this only actually blew up three/four weeks ago, FH got the restraining order request into court quite quickly. Much to her disappointment.

    Sadly, it is how the law works in a lot of areas. But in trademark law, not so much.

    That's what I mean. If E L James brought out a book called "Cocky Dom", FH would go nowhere near it. (Actually, it's reported that James retweeted the link to the Cocktales anthology to her 1.3million twitter followers which put the book in the top 20 on Amazon's rankings). But Crescent and Watson are fair game to her, neither have 1.3 million followers or multi million pound bank accounts.

    You can't pick and choose.

    to begin with? I am genuinely confused by this phenomena.

    FH can't write, sellz 600,000 books. E L Fudge can't write sells a few
    million books. What the fuck is wrong with this picture?

    Romance also has some of the best writing. I’m reading “Wildsky” right now and in my opinion its brilliant. I have to write about wizards and shit to be interesting. This book keeps me interested with like 10 pages about people staining a deck. You have to be really good to make slice of life interesting.

    Sorry I asked and made a sincere observation and question.
    Figured one should ask what/why when something doesn't
    makes sense. Not taking a shot at the genre as a whole, just
    at those that write poorly and seem to be rolling in it.

    But if you just want to burn me for asking a question then
    so be it, I have no reason to worry about it, since there are
    things worse than than death to consider. :p

    Don't bother replying cause asking a genuine question does
    not ever need an answer if the first thing is going to be a bloody
    witch hunt. So thanks for wanting to burn me at the stake, but
    I think I will not bother with asking any more 'real questions'
    ever again.
