The law may differ depending on the country/state but in the UK it's about seven years as long as there is evidence to support the person has not been seen or heard of and inquiries have been exhausted. I don't think it's a simple process, though. A lot of ifs and buts. If you google 'death in absentia' you'll find the relevant law.
