How long does someone have to be missing before they are declared dead?

weird question but the main plot of my story is kicked off. By one of the main characters friends going missing and I fel this info is something I need to know for possible drama when he turns up again.

The law may differ depending on the country/state but in the UK it's about seven years as long as there is evidence to support the person has not been seen or heard of and inquiries have been exhausted. I don't think it's a simple process, though. A lot of ifs and buts.

If you google 'death in absentia' you'll find the relevant law.

Seven or eight years seems to be the norm in most places.
