    It's a civil case. Therefore it'd be heard by a judge (probably a circuit judge or maybe a high court judge if it was serious enough). Magistrates only hear criminal cases which are defined as summary only or certain triable either way offences.

    Got Heather's card returned back to me. :( Which is actually not so very bad, since now I know it didn't get lost in the mail, but I just wish it would have arrived where it had to (which was impossible btw, because I wrote a 6 somewhere instead of a 5...).

    Scotland has always had it's own distinct legal system. I did an LLB in Scots Law and wouldn't even be able to practice in England unless I decided to undertake a conversion course. They are pretty different although in civil cases, both Scots and English precedent is persuasive in deciding cases in the other jurisdiction.

    There aren't Magistrates in Scotland but there are Lay Justices in the District Court, which is the lowest tariff criminal court in Scotland. It can't impose fines over a certain amount and I don't think it can impose prison sentences over 60 days. I'm pretty sure it's the same as Magistrates Courts in England.

    It's weird how ppl often don't know about the hierarchy of the Courts in their own country. I think the legal system is designed to mystify the public. I wouldn't have known how it all operates if I hadn't studied it.

    Ugh I've been lumped with making my sister's wedding invitations for her wedding in July. Each one is like a work of art I tell you - on each is a strip of lace, organza ribbon and gold bow.

    Almost finished - I hope she buys me a little gift for my efforts. I need to drop some hints. I'm making 80 of these blasted things.

    Ashleigh-:( Wish I could take some weight off you. Believe it or not, being stick thin isn't all that great either. The taunts I get from everyone. Make my life hell. But no matter how much I eat(my normal diet), I don't gain. And I can't go on a regulation diet. So I put up with it. *hugs*

    Emily-That's sad :(. I pray to God, they get through this time and recover fast.

    Jack-Moms are like that ;), don't listen to her(Sorry @ all Moms out there)

    Gigi-Sympathies. One of my best-friends is a wrestling manaic. You can't imagine the hours I've slept on phone listening to wrestling stats. And get this. It's a girl. lol, I know, my choice sucks lol.

    I hatehateatehatehate PMS. It makes me cry! And not the kind of crying I like to do!! And it makes me bored, I don't want to do anything, but I want to do something. Sigh.

    Also. I hatehatehatehatehatehate taking vitaming capsules. Those things on't suit me, they make me puke! Aaaaagh!

    Also, anyone who hates anything should go to hatebook.com. It's pretty cool and lets off a lot of negativity. Plus, hating stuff is legal there.

    Well... by 'just' I mean yesterday. :p It was some period-mood crying... I cry for no apparent reason, I'm weird like that.

    My boyfriends mum just called me, apparently he nearly had a seizure today so he had to be taken to hospital. I'm extremely worried for him, she says he's alright now, he just needs to rest.. I wish I could talk to him, or see him. Why do the people I care about the most have to suffer like this?

    Sorry to hear that happened Zoe, I hope he's alright.

    Medical things like that are especially scary for those of us running without medical insurance. I'm just waiting to get horrifically sick again, and then having to deal with it without going to the doctor. It's a precarious situation at best.

    Spoiler tagging this...I just need to vent...

    I am immensely irritated right now. Two nights ago, our cashier at work fainted. There were several customers there, people jumped in to help me and the other manager take care of her while another associate called 911. Ultimately, everything turned out ok.

    Then, not an hour later, my district manager called. Apparently there had been a complaint about someone swearing...seriously, someone passes out, and the only thing a customer can think to do is file a complaint that someone cussed?? But, I digress. I told my DM that while I was up there, I didn't hear any of the associates swearing, but it might have been coming from the paramedics. Issue resolved, I thought.

    Fast forward...we got an email recap of what the customer complaint said. First of all, she said it took twenty minutes for someone to call 911 after our cashier fainted, which is complete crap, because I was called to the front as soon as it happened, and when I got there, someone was already on the phone with them. Then she said that someone suggested giving the cashier hard candy to get her blood sugar up (she's diabetic), and when the complaining customer argued that she could choke on hard candy, either I or the other manager there responded with "I don't give a sh*t what you say, this isn't your store." Now, I was there, and I know no one said this, so I already know it's a lie, but even if I had experienced some sort of memory loss and just couldn't remember it, the other manager was a guy...if someone told you that they didn't give a sh*t about what you just said, would you be able to remember whether it had been a girl or a guy saying it?? I think so. We had three customers who were hanging out trying to help-one was with us behind the counter, there was a man giving us suggestions, and then there was a woman who said "oh, I'm a blah blah blah type of nurse, I know exactly what to do" and then proceeded to just lament that she had taken her equipment out of her bag just this morning...I'm pretty sure it was the third one that complained, and I'm pretty sure it was just because she was pissed that we didn't fawn all over her for being a nurse and chose instead to listen to the people making productive suggestions.

    This is a pretty long and ultimately pointless rant, but it really, really pisses me off that someone would take a situation like that, which is already stressful for everyone, and turn it into something ridiculous all because there was too much going on for me or the other manager to stand there and take notes while she told us how to do exactly what we were already doing. Petty, selfish, and she's just wasting everyone's time by making us go through the motions of resolving an issue that is a complete, blatant lie.

    I spoke to him a couple of hours ago, he seemed okay, still just experiencing the after symptoms of his fit (mainly headache and muscle-aches). I'm going to visit him tomorrow to check up on him. Thanks for the best wishes guys, I appreciate it. '

    Also flamingo, luckily I live in Australia, so medical insurance is pretty affordable. My boyfriend tells me on full coverage so at least if anything super serious happens he'll be well looked after.

    Wow, Heather...I don't even know what to say to that.
    If your supposition is correct, then that's just so blatantly selfish...
    I've had similar things happen to me where people have lied about me to get me into trouble because I didn't buy into their BS.
    It's extremely frustrating.

    Why was the DM even listening to that customer? Given the situation, I'd have filed it as a crank complaint.

    Yeah, I am unbelievably pissed right now. I'm just glad that we had so many witnesses...obviously we have no way of getting in touch with the other customers involved, but in addition to me and the other manager present, we had two associates up there who can back up our story. If it had been just me, I probably would have been in big trouble...still, though, it sucks that this came up the week that I'm interviewing for assistant store manager. Gaaaaaah. Some people...

    edit: Yeah, Cog, I was thinking the same thing. That's pretty much the stance my store manager took when he heard about the complaint, but when the DM calls the store personally to investigate, clearly he's taking it seriously...

    He could have just called so he can say he dug as deep as he could into the situation and didn't just pass the customer off- however unlikely their claim.

    Eoz-*hugs* Hope his recovery's fast. I'm sure having you there will just make him happier.

    Heather-:mad: Dislike people like that. She's probably just some woman who has nothing to do in her life and therefore gets digs making other people miserable. Don't dignify her attitude by sparing a single another thought to her. She doesn't deserve it. P.S. Hope your interview turns out succesful. All the best with that.

    Quite petty compared to everyone else's problems, but there you have it.
